A professional eviction management and litigation service offered on a monthly subscription basis, linked to a specific rental property.

Designed to follow the correct legal process from the outset — keeping you compliant with SA's tenant-centric eviction laws while keeping costs predictable.

What it is not

This product is not insurance. It does not indemnify rental income, damages or municipal/levy liabilities.

It is a legal-process service: the right notices, the right escalation, and the right attorney mandate — at the right time.

The eviction process

Four clear stages. Stages 1–2 are eviction management. Stage 3 unlocks formal litigation.

STAGE 1

Breach Notice (Eviction Management)

A formal breach notice is generated and issued to the tenant from your portal. Tracked, time-stamped and compliant.

STAGE 2

Termination (Eviction Management)

If the breach is not remedied within the prescribed period, the lease is formally cancelled.

STAGE 3

Excess & Legal Mandate

A once-off excess of R1,500 is payable to authorise formal legal proceedings. The portal gates this step until paid.

STAGE 4

Eviction Litigation

Formal eviction proceedings are instituted in court by an Evixa-appointed attorney.

All steps prior to Stage 3 pertain to eviction management rather than litigation.


How it works once you're registered

From signup, through monthly billing, to a real-world breach.

1. Register & enrol your property

Create your account, capture each rental property, tenant details and lease information. Subscriptions are linked to the property — not the landlord — so each rental unit needs its own enrolment.

2. Activate the monthly subscription

Recurring debit order via Netcash. Direct landlords pay R159/property/month; agency portfolios qualify for tiered pricing from R129 down to R70/property/month based on volume.

3. Property is protected & monitored

Once active, the property qualifies for the full eviction framework. Generate breach notices, manage tenants and view your statement of account from one portal.

4. A breach occurs — trigger the process

If a tenant defaults, open an eviction in the portal. A templated, compliant Stage 1 breach notice is generated and served. The case progresses through stages 2–4 with full status tracking.

5. Pay the R1,500 excess to escalate

If the breach isn't remedied and the lease is cancelled, the once-off R1,500 excess is paid through the portal to mandate formal litigation. Standard eviction disbursements are then included (subject to fair-use).

6. Litigation handled end-to-end

An Evixa-appointed attorney institutes formal eviction proceedings. You track progress in the portal and qualify for preferential legal rates on additional services while your subscription is active.

Service eligibility

  • A valid written lease agreement exists
  • Tenant was not in arrears at enrolment (or arrears fully remedied)
  • No existing disputes at time of trigger
  • One eviction process per property per 18-month cycle

Limitations & exclusions

  • Tenants already in arrears at enrolment (until remedied)
  • Urgent eviction applications
  • Appeals, rescissions, or reviews
  • Hijacked properties or unlawful occupation
  • Criminal or violent conduct
  • Existing disputes or defective lease

Full disclosure required: failure to disclose existing disputes, prior legal action or unlawful occupation may result in conversion to a separate billable mandate.

Frequently asked questions

Is this insurance?

No. Evixa Eviction Protection is a subscription-based legal-process service — not an insurance product. It does not indemnify rental income, damages or municipal/levy liabilities. You receive structured eviction management and, when required, formal litigation through an Evixa-appointed attorney.

Is the subscription per landlord or per property?

Per property. Each enrolled rental unit has its own subscription linked to that property's lease, tenant and eviction record — whether you are a direct landlord or a managing agent on a portfolio.

How many evictions does my subscription cover?

One full eviction process per property per 18-month cycle, subject to eligibility and fair-use rules. Additional or repeat matters may be converted to a separate billable mandate.

When is the R1,500 excess payable?

Only when you escalate to Stage 3 — formal litigation. The portal gates this step until the once-off R1,500 excess is paid. Standard eviction disbursements are then included, subject to fair-use.

What about additional legal services?

While your subscription is active, you qualify for preferential legal rates on additional services beyond the enrolled eviction process. Your attorney mandate and any extra work are tracked in the portal.

Your data & partner communications (POPIA)

By creating an account you acknowledge that, in line with the Protection of Personal Information Act, 2013 (POPIA), Evixa may from time to time share your name, email address and phone number with vetted partner companies whose products are relevant to landlords and managing agents (for example: insurance, tenant screening, property management software, and financial services).

Partner companies may contact you to position related products. This consent is opt-in at signup and you can withdraw consent at any time from Settings → Privacy, or by emailing privacy@evixa.co.za.

You retain all rights granted by POPIA, including the right to access, correct or delete your personal information, object to processing, and lodge a complaint with the Information Regulator.
